Barbour County man indicted on drug charge | USAO-NDWV

ELKINS, WEST VIRGINIA – Joseph Wayne Dadisman, of Philippi, West Virginia, was indicted today on a drug charge, United States Attorney William J. Ihlenfeld, II announced.

Dadisman, 49, was indicted on one count of “Possession with intent to Distribute Methamphetamine.” Dadisman is accused of having more than 50 grams of methamphetamine, also known as “crystal meth” and “ice,” in June in Barbour County.

Dadisman faces at least 10 years and up to life incarceration and a fine of up to $10,, Under the Federal Sentencing Guidelines, the actual sentence imposed will be based upon the seriousness of the offenses and the prior criminal history, if any, of the defendant.

Assistant U.S. Attorney Stephen D. Warner is prosecuting the case on behalf of the government. The Mountain Region Drug Task Force and the Barbour County Sheriff’s Office investigated.

An indictment is merely an accusation. A defendant is presumed innocent unless and until proven guilty.

    Barbour County, WV Prosecuting Attorney

    Every four years, the citizens of Barbour County elect a prosecuting attorney. This position is full-time, and outside employment prohibited. The prosecuting attorney is the chief legal officer of the county, with responsibility in both criminal and civil cases. In criminal cases, the prosecuting attorney assists in the investigation of all crimes and other law violations in the county.

    The prosecuting attorney may also be called upon to assist the state attorney general in state legal actions within the county. The prosecuting attorney’s office must be kept open during elections and be available to advise election officials or answer questions from the public. Other duties and responsibilities include:

    The Circuit Court Clerk of Barbour County takes on responsibility for carrying out administrative functions and acts as record-keeper for circuit court and family court matters. The responsibilities includes, serving as the Clerk to the Circuit and Family Court, issuing service of process for court cases, issuing final process to enforce and execute judgments, appoint a guardian ad litem where required, respond to other requests that do not require a court order, responsible for all papers filed in the office; serve as registrar, recorder and custodian for all pleadings, documents and funds pertaining to cases filed in circuit court and family court.     24 indicted by Barbour grand jury

    PHILIPPI &#; A man was indicted by a Barbour County grand jury Monday in relation to a five-vehicle crash in which two people died.

    James D. Curtis, 76, of Elkins, leaving the scene of a crash resulting in death, two counts of negligent homicide, and two counts of reckless driving with serious bodily injury.

    The wreck occurred Sept. 12 on US near Corley Church in Barbour County.

    Also indicted Monday were:

    Darius A. Humphrey, 26, Belington, malicious assault, strangulation, domestic battery, unlawful restraint, child abuse creating risk of injury.

    John M. Jones III, 32, Philippi, three counts attempt to commit malicious assault on a law enforcement officer, one count fleeing on foot.

    Ray T. Getz, 59, Philippi, first-degree sexual abuse, sexual abuse by parent, guardian, custodian or person in a position of trust.

    Matthew S. Upton, 40, Philippi, fleeing with reckless indifference, fleeing under the influence of a controlled substance.

    Nicholas S. Poe, 22, Hambleton, fleeing with reckless indifference.

    Donna M. Schalizki, 38, Philippi, DUI causing injury, failure to appear.

    Man accused of raping young child

    A West Virginia man, with a previous history of sexual violence, has been charged with allegedly raping a 7-year-old.

    Joshua Carbaugh, years-old, was arraigned Wednesday morning after being indicted nearly months ago by a Muskingum County grand jury.

    According to the Barbour County, WV prosecutors office, Carbaugh was indicted back in May of for a third-degree felony of sexual abuse by a parent, guardian or custodian.

    He ultimately pleaded to a lesser charge of sexual assault in December of

    At sentencing, the Barbour County judge sentenced Carbaugh to between one and five years in state prison in his home state of West Virginia for his crimes.

    Due to his conviction, he was also forced to register as a sex offender.

    It is unknown how long Carbaugh remained in prison, but sometime in he was released from parole supervision and given extended sex offender supervision.

    According to his indictment in Muskingum County, Carbaugh is accused of raping a 7-year-old sometime around October or November of

    Muskingum County grand jurors in January of indicted Carbaugh of the following 5 criminal charges.

    Count 1: Rape of a victim less than 10 years old, a first-degree felony.

    Count 2: Gross sexual imposition, a third-degree felony.

    Counts Failure to register as a sex offender, a third-degree felony.

    If convicted Carbaugh faces up to life in prison.

    Wednesday morning during his arraignment, Carbaugh pleaded not guilty to all charges.
