Airbnb Must Remove Illegal Santa Monica Listings

Airbnb, City of Santa Monica come to a compliance agreement

The City of Santa Monica and vacation rental platform Airbnb have come to an agreement intended to ensure all of the company’s listings comply with the City’s short-term rental laws, which are some of the strictest in the country.

“After years of uncertainty for our host community in Santa Monica, the new settlement agreement provides our hosts the clarity they need to continue sharing their homes,” said Matt Middlebrook, Airbnb’s Head of Public Policy in California.

Under the agreement, announced Tuesday, Airbnb will remove illegal short-term rental listings upon City notice, monitor and remove multiple listings that exceed the City’s home-sharing limit and collect and pay a $2 per night to help support affordable housing in Santa Monica.

“We now can better protect real permanent homes, especially our affordable rent-controlled apartments, from being used as de facto hotel rooms, displacing our neighbors,” said Santa Monica City Councilmember Kevin McKeown.

Santa Monica has some of the strictest home-share regulations in the United States, outlawing rentals of whole houses to tourists and travelers for under 30 days. In addition, vacation-rental hosts in Santa Monica can only rent individual rooms to guests and must be present in the residence throughout the entire stay and hosts cannot have more than one listing at a time.

The City of Santa Monica and Airbnb began negotiating an agreement in August when the U.S. Court of Appeals for the Ninth Circuit reaffirmed its rejection of Airbnb, Inc. and’s challenge to the City’s home-sharing ordinance, which penalizes the online platforms for unlawfully booking short-term vacation rentals of unlicensed properties in Santa Monica.

The vacation-rental companies argued that the City’s ordinance ran afoul of the Communications Decency Act and the First Amendment because it required the platforms to monitor the content of third-party listings on their sites and remove listings for unlicensed properties. A panel of the Ninth Circuit rejected this argument finding that the Ordinance only “prohibits processing transactions for unregistered properties” and does not proscribe, mandate, or even discuss the content of the listings that the Platforms display on their websites. It requires only that transactions involve licensed properties.”

“We have fervently defended our ordinance and are pleased to reach a settlement with Airbnb that creates a workable system that aligns with our goal of protecting the City’s housing supply,” said City Attorney Lane Dilg. “This agreement with Airbnb will make the City’s enforcement efforts less costly and more effective; most importantly, it will preserve housing for our residents. This is a positive outcome for Santa Monica.”

According to the City, there are currently 351 registered home-shares in the city with Airbnb accounting for a large majority of the listings.

Last month, Airbnb and the City of Los Angeles came to a similar agreement intended to bolster compliance with LA’s regulations.


Santa Monica and Airbnb settle case after appeals court rules for city

Airbnb reached a settlement with Santa Monica on Tuesday to collect money from renters for affordable housing in the city and ensure compliance with strict short-term rental rules.

A federal appeals court in March unanimously rejected Airbnb’s challenge of Santa Monica’s 2015 home-sharing ordinance, which prohibits short-term rentals if the owner is not on the premises.

City officials adopted the ordinance after receiving complaints of disturbances in normally quiet residential neighborhoods.

Airbnb will now require all listings to have a license number issued by the city. The company will permit each host to list only one dwelling and no more than two rooms in that home. Airbnb also will collect $2 a night from renters and pass it on to the city to be used for affordable housing. The company charges similar fees in other cities.

City Atty. Lane Dilg said the agreement would ease enforcement of the ordinance and help preserve housing.

Santa Monica has 351 registered home-shares, most of them rented through Airbnb. In addition to requiring hosts to remain on the premises, the city limits rentals to fewer than 31 days.

Santa Monica Mayor Kevin McKeown said the agreement would “better protect real permanent homes, especially our affordable rent-controlled apartments, from being used as de facto hotel rooms.”

The settlement requires Airbnb to take down illegal listings when notified by the city. The agreement is effective immediately and is expected to be fully in place by the end of January.

“After years of uncertainty for our host community in Santa Monica, the new settlement agreement provides our hosts the clarity they need to continue sharing their homes,” said Matt Middlebrook, Airbnb’s public policy chief for California.

In addition to Airbnb’s lawsuit against the city, Santa Monica resident Arlene Rosenblatt also challenged the ordinance. Her suit charged that the ordinance hindered commerce in violation of the U.S. Constitution.

Rosenblatt had been renting out her home for $350 a night when she and her husband traveled. The 9th Circuit Court of Appeals rejected her lawsuit in October.

Santa Monica Reaches Deal With Airbnb Over Illegal Listings

SANTA MONICA (CBSLA) – The city of Santa Monica Tuesday signed an agreement with short-term home sharing giant Airbnb designed to reduce the number of illegal listings in the city.

Under the deal, Airbnb will require all its hosts to register with the city and obtain a license number and business permit, the city announced. Hosts are also prohibited from listing multiple properties.

Furthermore, customers will be required to pay a $2 fee per night booked which will go towards helping Santa Monica set up more affordable housing.

“We now can better protect real permanent homes, especially our affordable rent-controlled apartments, from being used as de facto hotel rooms, displacing our neighbors,” Santa Monica Councilman Kevin McKeown said in a statement. “This hard-earned settlement is a win for affordable housing, a win for our neighborhoods, and a win for residents who welcome guests through legal home sharing.”

Santa Monica had prohibited short-term residential rentals for decades, but eased the ban in 2015 by passing an ordinance which allowed residents to host paying visitors for 31 days or less.

However, under that ordinance, hosts were required to be licensed with the city and must remain on site during their guest’s stay. The ordinance was designed to keep homes from being turned into de facto hotels.

The legislation was further amended in 2017 when the city banned home sharing platforms from collecting payments from bookings through unlicensed hosts.

That amendment prompted Airbnb and HomeAway to sue the city, claiming the ordinance violated the federal Communications Decency Act of 1996. In March, the Ninth Circuit Court of Appeals sided with the city.

This new deal was in response to that lawsuit.

There are currently 351 registered home-shares in Santa Monica, with the large majority coming from Airbnb.

Back in December of 2018, the Los Angeles City Council approved an ordinance that limits the number of days under which property owners can rent out their residences through home sharing platforms.
